HB2405

Modifies provisions relating to the collateral source rule

Introduced·1/7/26
Introduced Text

Modifies the collateral source rule to prevent recovery of special damages paid by defendants or their insurers.

The bill modifies the collateral source rule in Missouri to prevent recovery of special damages that have been paid by defendants or their insurers. If a defendant or their insurer pays for a plaintiff's medical care or treatment, the plaintiff cannot recover those costs from the defendant. The bill also allows the actual cost of medical care or treatment to be admissible as evidence, provided it has not been discounted or satisfied by a payment. This change affects personal injury, bodily injury, or death cases in Missouri.
