HB2254

Establishes provisions for postconviction relief to set aside a sentence of death in Missouri.

Missouri HB2254 sets forth provisions for postconviction relief to set aside a sentence of death. It mandates that the circuit court, upon imposing a death sentence, must find on the record whether the defendant is indigent and competent to decide whether to accept appointed counsel. If the defendant is indigent, the court must appoint two counsel to represent the defendant in the postconviction phase.
