HB2099

Missouri HB2099 modifies unlawful occupancy laws for private noncommercial property.

Missouri HB2099 revises provisions for unlawful occupancy of private noncommercial property. It allows property owners to petition for ex parte orders to remove unlawful occupants. The sheriff can enforce these orders, charging a reasonable hourly rate. The bill outlines terms like "petitioner," "unlawful occupant," and "respondent." It also details the court's authority to issue restraining orders and the sheriff's role in enforcement. The sheriff is immune from liability for good faith actions. The bill includes provisions for damages and civil actions if removal is without just cause.
