HB1755

Establishes the "Act Against Abusive Website Access Litigation" to allow Missouri residents to sue for abusive litigation.

The "Act Against Abusive Website Access Litigation" allows Missouri residents and businesses subject to litigation alleging website access violations to file a civil action against the party, attorney, or law firm that initiated such litigation. The act defines "abusive litigation" and outlines factors for determining if litigation is abusive, including the resources available to the defendant and the nature of settlement discussions. The court may award attorney's fees, costs, and punitive damages if the litigation is found to be abusive.
