HB1646

Missouri HB1646 modifies the collateral source rule to limit admissibility of certain evidence in personal injury cases.

Missouri HB1646 modifies the collateral source rule by limiting the admissibility of evidence related to payments made by collateral sources. Specifically, it states that no evidence of collateral sources, or payments rendered under certain conditions, shall be admissible other than as provided in the new section. If a defendant or their insurer pays all or part of a plaintiff's special damages before trial, the plaintiff cannot recover those amounts from the defendant. If such payments are included in the plaintiff's claim at trial, the defendant is entitled to a credit for the amounts paid.
