Mississippi SB2105 allows courts to authorize cash bail deposits in lieu of surety or property bonds.

Mississippi SB2105 amends Section 99-5-9 of the Mississippi Code to allow courts to authorize defendants to post a cash deposit as bail, provided it is at least 10% of the total bail amount. This cash deposit can replace surety or property bonds. The defendant must meet all conditions set out in the Mississippi Rules of Criminal Procedure and execute a sworn affidavit affirming eligibility. The clerk of the court must provide written notice to the defendant of their bail options, including cash deposit and professional bail agent options. The act takes effect on July 1, 2026.
