Mississippi HB748 amends Section 99-39-7 of the Mississippi Code of 1972 to mandate that individuals seeking post-conviction collateral relief must first obtain permission from the Mississippi Supreme Court before filing their motion in trial court. This requirement applies if the petitioner's conviction and sentence have been affirmed on appeal or the appeal dismissed, or if the denial of a previous post-conviction motion has been affirmed on appeal or more than three years have elapsed since the time for taking an appeal from the judgment or conviction.
