Mississippi HB1158 amends the state code to require a probable cause hearing before a person can be arrested for misdemeanors and felonies. This change applies to all arrests except those made in the actual commission of an offense, on pursuit, or with an outstanding warrant. The bill also mandates that any officer investigating a misdemeanor or felony that is a crime of domestic violence must file an affidavit on behalf of the victim if probable cause is found within 24 hours of the offense. The act takes effect from July 1, 2026.
