Mississippi HB1149 allows courts to authorize defendants to post a cash deposit in lieu of a surety or property bond.

Mississippi HB1149 amends Section 99-5-9 of the Mississippi Code to authorize courts to allow defendants to post a cash deposit of at least 10% of the total bail amount instead of a surety or property bond. This option is available if the defendant meets all conditions set out in the Mississippi Rules of Criminal Procedure and executes a sworn affidavit of eligibility. The clerk of the court must provide written notice to the defendant of their bail options before accepting any payment.
