Municipal annexation or deannexation requires an election in the affected territory.

Mississippi HB1106 amends the state code to require an election in the territory to be annexed or removed from a municipality. The election must be held within 60 days of the ordinance passage, with notice published in a local newspaper for three consecutive weeks. Only residents of the affected area can vote. The municipal authorities must pay attorney's fees and court costs if they appeal the election results. The bill also repeals the requirement to file an enlargement or contraction petition in chancery court.
