Michigan SB0393 revises the limitation periods for filing actions related to groundwater contamination.

Michigan SB0393 amends the limitation periods for filing actions related to groundwater contamination. It sets a 6-year period for filing actions for response activity costs and natural resources damages, starting from the initiation of physical on-site construction activities for a remedial action. For subsequent actions for recovery of response activity costs, the period is 3 years from the completion of all response activity. Civil fines must be filed within 3 years of discovering the violation.
