Michigan SB0095 prohibits hospitals from collecting debts if they are not in compliance with hospital price transparency laws.

Michigan SB0095, known as the "hospital price transparency act," prohibits hospitals from collecting debts from patients or patient guarantors if the hospital was not in compliance with hospital price transparency laws on the date items and services were provided. If a hospital takes a collection action under such circumstances, the patient or patient guarantor may file a civil action. The hospital must refund any amount paid and pay a penalty equal to the total amount of the debt. The hospital must also dismiss any court action based on the debt and pay any related attorney fees and costs.
