Michigan HB6140 prohibits elected officials from entering into nondisclosure agreements related to data center construction.

Michigan HB6140, known as the "data center transparency act," prohibits elected officials from entering into nondisclosure agreements related to the construction of data centers in exchange for tax incentives. This act applies to agreements entered into, amended, extended, or renewed after its effective date. It does not prohibit redactions related to intellectual property, but allows certain state entities to review redacted information. The act will only take effect if other specified bills are also enacted into law.
