Introduced Text

Allows liability for criminal sexual conduct by public university or college or school district employees or agents.

The bill amends Michigan's governmental immunity law to allow public universities, colleges, and school districts to be held liable for criminal sexual conduct committed by their employees or agents during employment or service. This applies if the institution was negligent in hiring, supervising, or training the individual, or if it had knowledge of prior acts of criminal sexual conduct by the individual. The immunity does not apply to cases where gross negligence is involved.
