Chamber Passed·6/4/26

Michigan HB5501 amends wetland mitigation requirements for development projects.

Michigan HB5501 amends the Natural Resources and Environmental Protection Act to modify wetland mitigation requirements for development projects. The bill allows for the replacement or relocation of wetlands within a development parcel if ecological function is maintained or improved. It also permits the use of credits from a wetland mitigation bank and allows for flexibility in mitigation ratios. The Department of Environmental Quality must consider various factors when setting mitigation ratios and may require financial assurance to ensure mitigation is accomplished.
