Introduced Text

Michigan HB4587 allows individuals subject to federal firearms disabilities to petition for relief from those disabilities.

Michigan HB4587 amends the Michigan Compiled Laws by adding a new section that allows individuals who are subject to federal firearms disabilities due to a state adjudication or commitment to petition for relief. The court must consider evidence regarding the petitioner's mental health, criminal history, and character before deciding whether to grant relief. If relief is granted, the department of state police must remove the relevant records from the national instant criminal background check system. The petitioner may appeal a denial of relief, and the review on appeal must be de novo.
