Michigan HB4439 prohibits employers from taking adverse actions against employees who refuse to work due to unsafe conditions.

Michigan HB4439 amends the Occupational Safety and Health Act to protect employees from employer retaliation. Employers cannot discharge, discriminate against, or retaliate against employees who refuse to work or report to work if they reasonably believe it would expose them or others to a communicable disease or unsafe conditions. The employee must have requested the employer to correct the condition, which must remain uncorrected at the time of refusal. The employee must also report the condition to the Michigan Occupational Safety and Health Administration.
