Chamber Passed·9/18/25

Allows patients to designate a surrogate for health care decisions when they are unable to make decisions themselves.

This bill amends the Michigan Estates and Protected Individuals Code to allow patients to designate a surrogate to make health care decisions on their behalf when they are unable to do so themselves. The bill establishes a priority order for selecting a surrogate, starting with a guardian, followed by a person named in a durable power of attorney, and then other relatives or friends based on their relationship and availability. The surrogate's authority is contingent on the patient's incapacity and ends when the patient regains capacity.
