Massachusetts S1561 amends the definition of fireworks to exclude novelty sparklers. The bill modifies the sixth paragraph of Section 39 of chapter 148 of the General Laws to clarify that novelty sparklers, including non-explosive and non-aerial sparkling devices, snake and glow worms, smoke devices, and trick noisemakers, are not considered fireworks. This change permits the sale and use of these items at all times. The bill also specifies that the exclusion does not apply to fireworks sold for shipment out of the commonwealth or for supervised displays, among other exceptions.
