Massachusetts S1448 amends variance rights expiration and renewal provisions.
Massachusetts S1448 modifies the rules for variance rights in zoning laws. If rights granted by a variance are not exercised within one year, they lapse. However, the permit granting authority can extend the exercise period by up to six months if a written application is submitted before the one-year period ends. If the extension is not granted, the rights can be reestablished only after notice and a new hearing.
