Black plastic includes any plastic with resin codes #1-#7. Exemptions apply for items purchased outside Massachusetts for personal use and prepared food packaged outside Massachusetts. The Department of Environmental Protection or the Board of Health may grant six-month exemptions for undue hardship or inventory drawdown. Violations incur fines up to $300 per day.
