Massachusetts H785, known as the "An Act protecting 340B contract pharmacies," aims to safeguard 340B contract pharmacies by prohibiting manufacturers, their agents, affiliates, distributors, or third-party logistics providers from denying, restricting, or prohibiting the acquisition or delivery of 340B drugs to authorized locations. It also bans requiring 340B entities to submit claims or utilization data as a condition for acquiring or delivering these drugs, unless mandated by federal law. Violations are considered section 11 violations of the Massachusetts Consumer Protection Act.
