Massachusetts H2701 amends Chapter 276 of the General Laws to allow for the detention of individuals in lawful custody if there is a written request from U.S. Immigration and Customs Enforcement (ICE) that there is probable cause the individual is a removable alien. The detention can only occur if there is also an administrative warrant of removal/deportation. The detention period cannot exceed 36 hours. The bill also mandates that judicial officers consider ICE detainers when setting bail.
