Massachusetts H2189 requires employers to allow employees to take bereavement leave for up to 10 business days within any 12-month period to grieve, make funeral arrangements, or attend a funeral for a family member. Employers can require documentation to verify the death and relationship. Employers have the discretion to decide if the leave is paid or unpaid. This act does not affect any existing policies or laws that provide greater leave rights. Employers with fewer than 25 employees are exempt from this requirement. The act will take effect on January 1, 2027.
