Massachusetts H1809 amends Chapter 188 of the General Laws to protect estates of deceased family members from foreclosure and other civil actions during probate. The bill allows courts to stay foreclosure actions if the estate's ability to make payments is materially affected by ongoing probate proceedings. The stay can be extended if the probate process continues to hinder payment. Creditors can still seek back payments with interest once a personal representative is appointed, but cannot charge fees for late payments unless the court finds good cause.
