Massachusetts H1771 modifies the handling of probation violations by altering the discretion courts have in sentencing. If a suspended sentence to the state prison is revoked, it must be served in full. For suspended sentences to the house of correction, courts can now impose either the full term or a portion of the sentence, with the remaining balance suspended. If a partial sentence is imposed, the remaining balance and its duration are reduced by the time served on revocation. Courts also have the discretion to revise probation conditions if they impose less than the full term.
