Massachusetts H1706 aims to encourage quality reviews and reduce costs in health care.

Massachusetts H1706 amends the General Laws to encourage quality reviews and reduce costs in health care. It modifies the calculation of damages in malpractice cases, limiting recovery for lost opportunities to survive or achieve better results to cases where the opportunity was greater than 50%. It also shifts the interest rate applied to judgments from the statutory rate to the average 1-year constant maturity Treasury yield plus 2 percent. The bill further mandates that plaintiffs bear the burden of proving the standard of care and causation in malpractice cases.
