Massachusetts H1544 amends Section 85K of Chapter 231 of the General Laws to clarify the charitable purposes of certain organizations. It specifies that being a charity will not be a defense in tort cases against corporations, trustees of trusts, or members of associations. However, if the tort was committed in the course of charitable activities and the organization derives more than 50% of its income from charitable gifts or donations, or if the organization was established primarily for religious purposes, liability is capped at $20,000, exclusive of interest and costs.
