Massachusetts H1045 clarifies liability for hazardous material releases when a permanent solution is achieved.

Massachusetts H1045 amends the state's environmental laws to establish that a department audit of response actions at a site with a permanent solution or remedy operations status is conclusive evidence of no liability for an eligible person. This applies if the Department of Environmental Protection has previously audited the site and determined that a permanent solution was achieved and maintained. The bill also prohibits the department from contesting liability if a permanent solution is achieved and maintained.
