An Act to Expand Municipal Authority over Utility Pole Permits

Complete·4/17/25

Expands municipal authority to revoke utility pole locations to municipalities with over 30,000 inhabitants.

The bill amends existing law to allow municipal officers in municipalities with more than 30,000 inhabitants to revoke the location of utility poles for electricity or telephone transmission in public streets, if necessary for public safety and welfare. Previously, this authority was limited to municipalities with over 40,000 inhabitants. The bill requires the pole owner to remove the poles within a reasonable time and grants alternative locations or joint use rights.
