Maine LD451 requires operators of solar and wind energy developments to test for perfluoroalkyl and polyfluoroalkyl substances (PFAS) contamination. The Maine Department of Environmental Protection must adopt rules for testing, including scope, third-party analysis, documentation, and evaluation. If PFAS contamination is found, the department issues a determination on its cause. If contamination is reasonably caused by the development, it no longer qualifies as a renewable resource or distributed generation resource. The owner or operator is responsible for remediation costs.
