This bill amends Maine law to allow municipal boards of appeals to grant variances for reconstructing or replacing storm-damaged commercial fisheries facilities and infrastructure. The variances can be granted if the property owner suffered substantial damage and the dock, pier, or wharf is proposed to be elevated or protected from flood damages. The bill also clarifies the definition of a "functionally dependent use" and allows variances even if the land can yield a reasonable return, provided the variance is necessary for reconstruction or replacement.
