Specifically, it exempts facilities that are owned or operated by a hospital if they are operated and paid only as an ambulatory surgical facility and do not share space with a hospital or the outpatient surgery department of a critical access hospital. The exemption applies even if the facility and the hospital or outpatient surgery department are not open at the same time.
