Maine LD1396 amends the definition of "subdivision" within land use planning laws to exclude certain divisions of land. The bill specifies that divisions accomplished by sale, lease, development, or other means do not create a lot unless the intent is to avoid the objectives of the law. It also excludes divisions by gift, condemnation, or creation of an accessory dwelling unit. The bill applies to divisions of land into or more dwelling units within a 5-year period and to divisions of new or existing structures into or more dwelling units. The changes take effect beginning January 1, 2026.
