LD1027

Maine LD1027 strengthens laws on relief for undue influence on elderly dependents in property transfers.

Maine LD1027 amends existing law to ensure that courts provide relief to elderly dependents who have been unduly influenced in property transfers. This includes rescission or reformation of deeds, imposition of constructive trusts, and orders for property return. The bill mandates that the person who exercised undue influence or the transferee who paid less than full consideration must pay reasonable attorney's fees and costs. Relief granted cannot affect mortgages, good faith purchasers, or other third parties with interests in the property.
