Louisiana SB67 sets stricter criteria for recovery in tort claims of emotional distress without physical injury.

Louisiana SB67 amends Civil Code Article 2315(C) to establish that recovery for mental anguish or emotional distress without physical injury requires severe, debilitating, and foreseeable distress supported by medical evidence. The bill also requires outrageous conduct by the defendant and a breach of a special, direct duty owed to the plaintiff. Effective August 1, 2026.
