Louisiana SB481 amends the Code of Criminal Procedure to limit appellate court review of new trial motions to cases involving errors of law.
Louisiana SB481 modifies the Code of Criminal Procedure to restrict the appellate or supervisory jurisdiction of courts in reviewing the granting or refusal of a new trial to instances where an error of law was committed. The bill also specifies that the showing of injustice required before granting a new trial is a question of law. Any granted motion for a new trial must prove either an error of law or the insufficiency of the evidence as a matter of law and will be reviewable under the new law. Effective August 1, 2026.
