It retains the authority for expropriation by the state and certain corporations, but prohibits expropriation by foreign powers, aliens, or corporations majority-owned by foreign powers, aliens, or projects approved by a multistate regional transmission organization. The bill also restricts expropriation by foreign adversaries identified by the U.S. Department of the Treasury. Property within 50 miles of a military base cannot be expropriated by these entities. The bill takes effect on August 1, 2026.
