Louisiana SB38 allows for the reissuance of a nursing facility license to a different holder if the original license was revoked during an evacuation.

Louisiana SB38 amends the licensing provisions for nursing facilities. If a nursing facility license is revoked due to failures during an evacuation under an executive order or declaration of emergency or disaster issued after 2021, the Louisiana Department of Health may reissue the license to another person who meets the licensure requirements. This provision applies only to facilities without an alternative within ten miles. The Act also mandates that the department update administrative rules on nursing facility licensure to reflect these changes.
