H.Con.Res.61

Louisiana HCR61 directs the Louisiana State Law Institute to study the constitutionality of expropriation for carbon capture and sequestration.

Louisiana HCR61, passed in 2026, authorizes and directs the Louisiana State Law Institute to study the constitutionality of expropriation as it pertains to carbon capture and sequestration. The resolution follows a Louisiana Supreme Court decision in Plaquemines Port Harbor and Terminal Dist. v. Nguyen, which held that a public port authority's expropriation of private property for the predominant use of a private company is unconstitutional.
