HB974

Louisiana HB974 amends bail laws to consider the presumption of innocence when setting bail and mandates timely hearings on bail reduction motions.

Louisiana HB974 amends the Code of Criminal Procedure to retain existing law on fixing the amount of bail, ensuring it ensures the defendant's presence and community safety. It adds the presumption of innocence until proven guilty as a factor in setting bail. The bill also mandates that motions to reduce bail must be heard within 30 days unless good cause is shown. Modifications of bail orders now terminate the liability of the defendant and sureties under the previous bail, requiring a new bail undertaking.
