Louisiana HB95 modifies the recovery of damages in automobile accidents by limiting past medical expense recovery to the amount that would have been paid by the claimant's health insurance if the claimant did not use it. The bill defines "health insurance coverage" to include benefits from various health insurance policies and programs. This limitation does not apply to claims made under the Louisiana Workers' Compensation Law.
