Louisiana HB402 modifies the Habitual Offender Law by altering sentencing for third-time felony offenders.

Louisiana HB402 amends the Habitual Offender Law to change sentencing for individuals convicted of a third felony. If the third felony and the two prior felonies are defined as crimes of violence without actual violence, the offender will receive a determinate term of not less than half the longest possible sentence for the first conviction and not more than twice that sentence. The bill defines "actual violence" as the use, attempted use, or threatened use of physical force against a person or property. HB402 applies retroactively to offenders sentenced or adjudicated prior to June 15, 2001.
