Louisiana HB310 amends the Code of Criminal Procedure to require the random reassignment of a defendant's case among all remaining judges when the defendant waives their right to a jury trial. This applies to district courts with three or more judges assigned to criminal matters. The defendant must file a written motion to waive the jury trial, signed by both the defendant and their counsel, at least 45 days before the trial date. The district attorney can also file a motion to waive the reassignment within ten days of the jury trial waiver being granted, which the court must then grant.
