HB1044

Louisiana HB1044 classifies future wages or earnings from employment contracts as separate property if they remain unearned at the end of a community.

Louisiana HB1044 amends the classification of separate property by specifying that future wages or earnings outlined in an employment contract executed during a community property regime are considered separate property of the contracting spouse if they remain unearned at the time the community property regime ends. This includes any amounts later paid as severance pay or liquidated damages. The bill aims to overrule the case Orgeron v. Orgeron, 413 So. 3d 390 (2025).
