Kentucky SB85 amends the Kentucky Revised Statutes to allow state-administered retirement benefits to be paid to a special needs trust. The bill defines a special needs trust as a trust described in U.S.C. sec. 1396p(d)(4)(A) or (C). The bill specifies that any retirement benefits paid to a special needs trust shall not be subject to claims for reimbursement from any state for Medicaid benefits paid on behalf of the beneficiary.
