Kentucky SB275 amends securities regulations to clarify the burden of proof for exemptions and exceptions from securities definitions.

Kentucky SB275 modifies the Kentucky Revised Statutes to specify that the burden of proving an exemption or exception from securities definitions falls on the person claiming it. The commissioner is granted authority to require a verified statement of all material facts for proposed sales, transactions, issues, or securities. If the commissioner finds the information misleading, incorrect, inadequate, or insufficient to establish the right of exemption, they may require additional information.
