Kentucky HB938 amends occupational health and safety laws to adjust civil penalties and phase in penalty increases.

Kentucky HB938 amends occupational health and safety laws by adjusting civil penalties for violations and phasing in increases. Starting August 1, 2026, the Secretary shall annually adjust penalties based on the Consumer Price Index. Penalties for willful or repeated violations can reach up to $140,000, while those for serious violations can be up to $14,000. Employers who fail to correct violations within the allotted time face additional fines. Penalties for knowingly making false statements or causing harm to inspectors are also outlined.
