Kentucky HB813 prohibits covenants not to compete and imposes penalties for violations.

Kentucky HB813 creates a new section in KRS Chapter 336 to prohibit employers from entering into, enforcing, or threatening to enforce covenants not to compete with covered employees. A covered employee is defined as one whose average weekly earnings are less than $2,000. The bill allows covered employees to bring a civil action against employers who violate this prohibition. The court has jurisdiction to void any such covenant and order relief, including injunctions, damages, and attorney fees. Employers must post a copy of this section where other employee notices are posted.
