HB559

AN ACT relating to data privacy, portability, and interoperability.

Introduced·2/4/26
Bill Text

Kentucky Digital Choice Act enhances data privacy, portability, and interoperability for social media users.

The Kentucky Digital Choice Act mandates that social media companies and model operators implement transparent, third-party accessible interoperability interfaces. These interfaces allow users to share their personal data between designated social media services and enable third parties to access user data with consent. The Act requires social media companies to provide users' personal data, including social graphs and contextual data, in a portable and usable format upon request. It also establishes a digital choice fund to manage civil penalties collected from violations.
